Terms of Service
Welcome to NewXperience, a service by create.repeat Oy ("we", "our", "us"). These Terms explain your rights and responsibilities when you use NewXperience. By creating an account or using the service, you agree to them. If you do not agree, please do not use the service.
1. Who we are
NewXperience is owned and operated by create.repeat Oy, a company registered in Finland (Business ID 2662670-6), Eteläinen Hesperiankatu 26 E 63, 00100 Helsinki, Finland.
2. What the service is
NewXperience is a catalogue of real-world experiences and collections of them. Content comes from two sources: content published by us, and content created and managed by users like you.
We do not organise, sell or run the experiences described in the catalogue unless a listing says so explicitly. Availability, prices, safety and suitability are the responsibility of whoever provides the activity.
Always use your own judgement before taking part in any activity, and follow the instructions and local rules that apply to it.
3. Eligibility and your account
You must be at least 15 years old to create an account, or have the consent of a guardian where required by local law.
You are responsible for everything that happens under your account. Keep your password to yourself and tell us if you think someone else has access.
You may close your account at any time from Settings, which also deletes the content you manage (see section 9).
4. Content you create
You keep ownership of the experiences, collections, ratings and reviews you publish. You grant us a non-exclusive, worldwide, royalty-free licence to store, display, translate and promote that content inside the service, for as long as you keep it published.
You are responsible for what you publish. By submitting content you confirm that:
It is accurate to the best of your knowledge, and you have the right to publish it.
It does not infringe anyone's rights, and contains no personal data about other people published without their consent.
If you list a place or business, you are entitled to describe it, and the practical details (address, phone, price, duration) are correct as far as you know.
5. Review and moderation
Content submitted by users is reviewed before it appears publicly, and changes to published content are reviewed again. We may decline, edit or remove content that is inaccurate, unlawful, unsafe, misleading, offensive or simply not a good fit for the catalogue.
Review is a quality step, not a guarantee: approval does not mean we have verified every detail of a listing.
Collections can accept experiences from other managers. In that case, the manager of the collection decides what their collection contains, and the manager of an experience decides whether it may be collected by others. Both permissions are yours to set and change at any time.
6. Content we publish
Some experiences and collections are published by us. Those, along with the software, design, logos and structure of the service, belong to us or our licensors and may not be copied, resold or reused outside the service without written permission.
7. Acceptable use
Do not use the service for unlawful, harmful, deceptive or fraudulent purposes.
Do not publish spam, advertising disguised as an experience, or content designed to mislead.
Do not attempt to break, overload or bypass the security of the service, or scrape it with automated tools.
Do not harass other users or publish content that targets or identifies private individuals without their consent.
8. Availability and changes
We develop the service continuously: features may be added, changed or removed, and updates may be deployed without prior notice. We aim for high availability but cannot promise the service will be uninterrupted or error-free.
9. Ending your use
You can stop using the service at any time. Deleting your account from Settings permanently removes your account and the experiences and collections you manage, along with your ratings, reviews and progress.
We may suspend or close an account that breaks these Terms.
10. Liability
The service is provided "as is". To the extent permitted by law, we are not liable for indirect or consequential damages, nor for anything that happens while you take part in an activity described in the catalogue.
Nothing in these Terms limits rights you have as a consumer under mandatory Finnish or EU law.
11. Governing law
These Terms are governed by Finnish law. Disputes are resolved in the courts of Helsinki, Finland, unless mandatory consumer law gives you the right to another forum.
12. Changes to these Terms
We may update these Terms. Each version has a number and a date. When we publish a new version, you will be asked to accept it the next time you use the service, and you can always read the current version at /privacy.
